Terms of Service

1. Acceptance of Terms

By accessing or using Road Sorties ("the Service"), you accept and agree to be bound by these Terms of Service. If you do not agree, do not use the Service. These Terms constitute a binding legal agreement between you and the operators of Road Sorties.

2. Description of Service

Road Sorties is a route planning service that provides driving directions, scenic and curvy road preferences, points of interest, and route export functionality. The Service uses third-party routing, mapping, and geocoding APIs to generate routes and location data. The Service is provided for personal, non-commercial use as a planning aid.

3. Eligibility

You must be at least 13 years old (or the age of digital consent in your jurisdiction) to use the Service. By using the Service you represent that you meet this requirement and that you have the legal capacity to agree to these Terms.

4. Use of the Service

You agree to use the Service only for lawful purposes and in accordance with these Terms. You agree not to:

  • Use the Service in any way that violates applicable laws, regulations, or third-party rights;
  • Abuse, overload, scrape, reverse-engineer, or attempt to gain unauthorized access to the Service, its data, or its infrastructure;
  • Use the Service for commercial purposes, resale, or redistribution without prior written authorization;
  • Submit content through the Service (including shared route names) that is unlawful, defamatory, infringing, or that contains personal information of others;
  • Interfere with the operation of the Service or with other users' use of the Service.

5. Third-Party Services and Data

The Service relies on OpenStreetMap, Nominatim, Valhalla, Foursquare, and other third-party data and APIs. Your use of the Service is also subject to the terms and policies of those providers. Road Sorties is not responsible for the availability, accuracy, completeness, or content of third-party services or data, and any reliance on third-party data is at your own risk.

6. Navigation and Route Disclaimer

Routes, directions, travel-time estimates, points of interest, road classifications (including "scenic" or "curvy" designations), and any other information provided by the Service are for general planning purposes only and may be inaccurate, incomplete, outdated, or unsuitable for your particular vehicle, skill level, or circumstances. Road conditions, closures, restrictions, weather, traffic, regulations, and surface quality may change at any time and are not necessarily reflected by the Service.

You are solely responsible for evaluating the suitability and safety of any route before and during travel. Always verify routes with official sources, obey posted traffic signs, road closures, and local laws, and exercise sound judgment behind the wheel. Do not interact with the Service while operating a vehicle in a manner that is unsafe or prohibited by law.

7. Assumption of Risk and Release

You acknowledge that travel — including travel on scenic, rural, mountain, or unpaved roads that the Service may suggest — involves inherent risks, including risk of personal injury, property damage, getting lost, encountering impassable conditions, and death. By using the Service, you knowingly and voluntarily assume all such risks. You are solely responsible for your safety, the safety of any passengers, and your vehicle and equipment.

To the fullest extent permitted by law, you release Road Sorties and its operators, contributors, and licensors from any claims, demands, and damages of every kind arising out of or related to your use of the Service. If you are a California resident, you expressly waive the protections of California Civil Code section 1542, which provides: "A general release does not extend to claims that the creditor or releasing party does not know or suspect to exist in his or her favor at the time of executing the release and that, if known by him or her, would have materially affected his or her settlement with the debtor or released party."

8. No Warranties

THE SERVICE AND ALL CONTENT, DATA, AND MATERIALS PROVIDED THROUGH IT ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY. TO THE FULLEST EXTENT PERMITTED BY LAW, ROAD SORTIES AND ITS OPERATORS, CONTRIBUTORS, AND LICENSORS DISCLAIM ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, NON-INFRINGEMENT, AND UNINTERRUPTED OR ERROR-FREE OPERATION. NO ADVICE OR INFORMATION OBTAINED FROM THE SERVICE CREATES ANY WARRANTY NOT EXPRESSLY STATED HERE.

9. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL ROAD SORTIES, ITS OPERATORS, CONTRIBUTORS, OR LICENSORS BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES — INCLUDING WITHOUT LIMITATION DAMAGES FOR PERSONAL INJURY, DEATH, PROPERTY DAMAGE, LOST PROFITS, LOST DATA, OR BUSINESS INTERRUPTION — ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF, OR INABILITY TO USE, THE SERVICE, ANY ROUTE OR INFORMATION OBTAINED FROM THE SERVICE, OR ANY THIRD-PARTY DATA, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY, OR ANY OTHER LEGAL THEORY, AND WHETHER OR NOT ROAD SORTIES HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

WHERE LIABILITY CANNOT BE EXCLUDED UNDER APPLICABLE LAW, THE TOTAL CUMULATIVE LIABILITY OF ROAD SORTIES TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THE SERVICE SHALL NOT EXCEED ONE HUNDRED U.S. DOLLARS (USD $100) OR THE AMOUNT YOU PAID, IF ANY, TO USE THE SERVICE IN THE TWELVE MONTHS BEFORE THE CLAIM, WHICHEVER IS GREATER. SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS, IN WHICH CASE THE ABOVE LIMITATIONS APPLY ONLY TO THE EXTENT PERMITTED.

10. Indemnification

You agree to indemnify, defend, and hold harmless Road Sorties and its operators, contributors, and licensors from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or related to (a) your use of the Service, (b) your violation of these Terms or applicable law, (c) your violation of any third-party right, or (d) any content you submit to the Service.

11. Privacy

Your use of the Service is also subject to our Privacy Policy, which is incorporated by reference into these Terms.

12. Modifications and Availability

We may modify, suspend, or discontinue the Service (in whole or in part) at any time, with or without notice, and without liability to you. We may update these Terms from time to time; continued use of the Service after changes constitutes acceptance of the revised Terms.

13. Governing Law and Dispute Resolution

These Terms are governed by the laws of the United States and the State of California, without regard to its conflict-of-laws principles. Any dispute arising out of or relating to these Terms or the Service shall be resolved exclusively in the state or federal courts located in California, and you consent to the personal jurisdiction of those courts. To the extent permitted by law, each party waives any right to a jury trial. Any claim must be brought within one (1) year after it accrues or be permanently barred, except where a longer period is required by California law.

14. Severability and Entire Agreement

If any provision of these Terms is held invalid or unenforceable, that provision shall be enforced to the maximum extent permissible and the remaining provisions shall remain in full force and effect. These Terms, together with the Privacy Policy, constitute the entire agreement between you and Road Sorties regarding the Service and supersede any prior agreements.

15. No Waiver; Assignment

Our failure to enforce any provision of these Terms is not a waiver of that provision. You may not assign or transfer these Terms without our prior written consent; any unauthorized assignment is void.

16. Force Majeure

Road Sorties is not liable for any failure or delay in performance caused by events beyond its reasonable control, including acts of God, natural disasters, network failures, government actions, labor disputes, or third-party service outages.
